Yeah, but is this really a non-compete covenant?
A non-compete would have attempted to prevent Towers from taking another similar type job for a set period of time. Obviously, that is not an issue here.
This is more along the lines of an intellectual property/non-disclosure type provision. The Padres don’t want Towers using knowledge he gained during his employment against them. Enforceable? I don’t know. But definitely NOT a traditional non-compete.
